As an arbitrator, Tricia hears all sides to a dispute, and makes a binding decision.
Tricia’s authority is derived from an arbitration clause, often found in a contract or other document that governs the parties’ relationship.
Particular rules of procedure and evidence will apply, but they are generally simpler than those in a judicial proceeding. Evidentiary rules are more relaxed, and discovery is often limited.
Arbitrations are generally administered by a dispute resolution organization, such as the American Arbitration Association, where Tricia serves on the commercial, consumer, healthcare, and expedited panels. The parties can mutually request Tricia, or select her from a rank-and-strike list provided by the AAA.
Tricia provides customized billing estimates based on the anticipated amount of work involved in the arbitration (e.g., number of hearing days, motion practice, anticipated discovery disputes, or special procedures).
